Terms & Conditions of Sale

1. About us

Bengal Welding Ltd (Company No. 16108626, registered in England & Wales, VAT No. GB 492099948), registered office 59 Bridge St, Wednesbury WS10 0AH.

2. These terms

These terms apply to sales to both business customers and consumers. If you buy as a consumer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

3. Ordering

Your order is an offer to buy. A contract is formed when we send you an order confirmation email. We may decline an order — for example where an item is unavailable or a price was displayed in error — and will refund any payment taken.

4. Prices & payment

Prices are in GBP and include VAT at the current rate; ex-VAT prices are shown for trade customers. Payment (or an agreed deposit) is required before fabrication begins. Delivery and installation charges are shown in the cart before you commit to pay.

5. Bespoke & made-to-order items

Most of our equipment is fabricated to your dimensions and specification. We will ask you to confirm measurements (and drawings where applicable) before fabrication starts. Bespoke items are exempt from the 14-day cancellation right described below.

6. Your 14-day right to cancel (consumers)

If you buy as a consumer, under the Consumer Contracts Regulations 2013 you may cancel your order for standard (non-bespoke) items up to 14 days after the day you receive the goods, without giving a reason. Tell us in writing (email is fine) within that period, return the goods at your cost within 14 days of telling us, and we will refund you — including standard delivery — within 14 days of receiving the goods back or proof of return.

Exemption: bespoke and made-to-order fabrication items — equipment made to your measurements or specification — are exempt from this cancellation right (regulation 28(1)(b)) once fabrication has begun.

7. Delivery & installation

Delivery and installation are provided as described in our Delivery & Installation Policy. Risk in the goods passes to you on delivery; ownership passes when we receive payment in full.

8. Faulty goods

Consumers have rights under the Consumer Rights Act 2015 where goods are faulty, including a short-term right to reject within 30 days. Business customers receive a 12-month workmanship warranty on fabricated items, covering repair or replacement at our option.

9. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud. For business customers, our total liability under a contract is limited to the price paid, and we are not liable for indirect losses such as loss of profit.

10. Governing law

These terms are governed by the law of England & Wales, and the courts of England & Wales have jurisdiction.
